[EN]: This article focuses on the growing trend towards government open data and addresses the re-use of data through public copyright licenses. After outlining some international schemes for open data, this study examines both the current legislative framework and some of the main existing initiatives in Spain. This evidence enables the identification of some shortcomings, among which is some deficit in interoperability. Then the analysis deals with the rules regulating data re-use under public copyright licenses and its application to the Spanish case. The findings show that the Creative Commons licenses properly fit into the Spanish legislation since they include all forms of dissemination and exploitation therein. Therefore, such licenses seem to be recommendable.
