Notas históricas sobre el problema de los símbolos religiosos

Abstract

The author focuses on two legal (and political) problems raised in recent years around certain religious symbols: firstly, the lack of freedom of those people who hold them (Islamic veil and burka wore by women), secondly, to defend freedom of those who do not want those symbols to be publicly exposed (crucifixes), and last, a more radical point of view who directly reject them (minarets and muezzins). He asks himself whether these three postures have coexisted before, and concludes that no, except in situations of violence. However, it is being frequent that each one of these three problems appears individually. This reasoning leads him to examine, from that point of view, the Portuguese revolution of 1910, the Spanish crisis of 1931-1939 and the "confessionalisation" of European nations in the nineteenth century.

El autor se centra en dos problemas jurídicos (y políticos) planteados en los últimos años en torno a determinados símbolos religiosos: el de defender la libertad de las propias personas que los ostentan (velo y burka islámicos) y la de aquellos que no los desean expresamente (crucifijos) o que los rechazan (minaretes y almuédanos). Se plantea si ha habido precedentes históricos del conjunto y concluye que no, salvo en situaciones de violencia y como medidas precisamente violentas. Sí los ha habido, en cambio, de cada uno de esos tipos de problemas por separado. El razonamiento le lleva a examinar, desde ese punto de vista, la revolución portuguesa de 1910, la crisis española de 1931-1939 y la “confesionalización” de las naciones europeas en el siglo XIX.
